Here’s an extract from my discussion of UKIPs policies dealing with their plan to “Remove the UK from the jurisdiction of the European Court of Human Rights.” Given that David Cameron has just announced the same policy I think it’s relevant to revisit what I wrote:
Firstly, it’s important to explain that the European Court of Human Rights has nothing to do with the European Union, it is an entirely separate entity. The court was established in 1959 in accordance with Article 19 of the European Convention on Human Rights as a judicial body tasked with enforcing the articles enshrined in the Convention. The Convention itself was principally drawn up by British MP, Sir David Maxwell-Fyfe, who had been a prosecutor at the Nuremberg Trials. The European Convention on Human Rights was drawn up as a direct response to the atrocities committed by the Nazis during World War II and the recognition that an internationally based legal framework needed to exist to hold such people accountable for their actions and, more widely, to protect the rights of the people of Europe. We, the British, played a central and intrinsic role in the establishment of the European Court of Human Rights. It’s an achievement we should be proud of, not something we should seek to abandon because at times it becomes politically inconvenient for us to respect the human rights of individual citizens. Every country in Europe, other than Belarus, is a signatory of the European Convention on Human Rights and therefore falls under the jurisdiction of the Court. That includes European countries that are not members of the EU, such as Russia and Norway. What message would it send to Vladamir Putin, a man that Nigel Farage has admitted that he admires, if we were to proclaim that we are no longer subject to the same standards of human rights observance that we expect him to be? We are better than that. UKIP claim to not be a party of the far right, but you have to wonder about any party that rejects the authority of a court that was established specifically as a response to the atrocities committed by the Nazi party.
Cameron suggested it was absurd to apply the Convention on Human Rights on the battle field, but that’s exactly why it was written…as a response to the atrocities committed by the Nazis during World War II.
